Return & Refund Policy
At Kansas Auction Service, we strive to provide accurate descriptions and quality service for all online auctions, onsite auctions, and fixed-price items listed on our website.
With respect to auction and consigned property, Kansas Auction Service acts solely as a disclosed agent for the seller and assumes no ownership interest in such property unless expressly stated. All auction items are offered on behalf of third-party sellers, and Kansas Auction Service disclaims any warranties, guarantees, or representations not expressly set forth in writing.
Please review these policies carefully before placing a bid or completing a purchase.
I. AUCTION ITEMS POLICY (Online & Onsite Auctions)
All Sales Final – AS-IS, WHERE-IS
All auction items are sold AS-IS, WHERE-IS, WITH ALL FAULTS.
By registering and/or placing a bid, the buyer acknowledges and agrees:
- No returns, refunds, or exchanges are permitted for auction items.
- No warranties or guarantees, express or implied, are provided, including warranties of merchantability or fitness for a particular purpose.
- Descriptions, photographs, and condition notes are provided as a courtesy and are not guarantees.
- Failure to inspect constitutes waiver of any claim regarding condition.
- Bids are binding contracts and cannot be canceled once placed.
- Auction purchases are final once the sale is announced or the lot closes.
Buyer’s Premium
A 13% buyer’s premium applies to all auction purchases unless otherwise stated in writing.
A 3% buyer’s premium rebate is offered for qualifying cash payments, if announced.
Soft Close & Extended Bidding
For timed online auctions, any bid placed within the final two (2) minutes of a lot’s scheduled closing time will extend bidding on that lot by an additional two (2) minutes.
Inspection & Condition Disclaimer
Auction items may include used, surplus, estate, repossessed, or consigned goods. Conditions vary widely.
- Mechanical or operational condition is not guaranteed.
- Hours, mileage, measurements, authenticity, or provenance are not guaranteed.
- Buyers assume all risk upon placing a bid.
Pickup, Risk of Loss & Abandonment
Buyers are solely responsible for providing adequate labor, equipment, and transportation for removal. Failure to bring proper equipment does not extend pickup deadlines.
Buyers must remove items within the scheduled pickup window.
Risk of loss transfers to the buyer immediately upon auction close, regardless of pickup status. Kansas Auction Service is not responsible for loss, theft, vandalism, fire, weather-related damage, or deterioration occurring after auction close.
Items not removed during the scheduled pickup window will incur a $25 per day, per item storage fee, unless prior written arrangements are approved.
If items must be removed due to buyer failure to pick up, the buyer agrees to reimburse all related costs including:
- Labor and personnel
- Equipment usage
- Transportation and fuel
- Third-party contractor or towing fees
- Disposal or recycling fees
- Administrative handling costs
Such charges will be billed at actual expense plus a 15% administrative fee and may be charged to the payment method on file.
Items not removed within seven (7) calendar days after the later of auction close or the final scheduled pickup day will be deemed abandoned and may be resold, disposed of, or otherwise liquidated without refund or credit.
Default & Non-Payment
Bids constitute legally binding contracts. Failure to remit payment within the stated deadline constitutes buyer default.
In the event of default, the buyer agrees to pay liquidated damages equal to 15% of the winning bid amount (minimum $25), plus any resale deficiency and associated costs.
Kansas Auction Service reserves the right to:
- Charge the card on file
- Resell the item without notice
- Suspend or permanently ban bidder privileges
- Pursue collections or legal remedies
Vehicles, Trailers & Titled Property (Auction Sales)
Vehicles, trailers, and titled equipment may be sold with a certificate of title, MSO, bill of sale only, or may require application for title.
All such items are sold AS-IS, WHERE-IS.
Buyer Responsibility
The buyer is solely responsible for:
- All applicable taxes (sales tax may be removed with valid exemption certificate provided prior to invoicing)
- Title transfer fees
- Registration and licensing fees
- Insurance
- Emissions or inspection requirements
- Compliance with state and federal laws
Kansas Auction Service does not provide temporary tags or permits.
Title Release
Titles and ownership documents will be held until full payment has been received and funds have cleared.
Risk of loss transfers at auction close; legal title transfers only upon receipt of cleared funds.
If sold with bill of sale only, no guarantee is made regarding ability to register or title the item. Failure to obtain title or registration does not constitute grounds for refund.
II. FIXED-PRICE WEBSITE ITEMS POLICY
This section applies only to items purchased at fixed price directly through our website and not through auction.
Errors or Damaged Products
If we made an error or an item arrives damaged:
- Contact: support@kansasauctionservice.com
- Within 7 days of delivery
- Provide up to 5 photos or 1 video of the error or damage
If approved, we may offer replacement or refund at our discretion.
Returns (Fixed-Price Items Only)
Eligible returns must:
- Be requested within 14 days of delivery
- Be unused and in original condition
- Include original packaging when applicable
Store Credit
- Issued for item price minus original shipping
- Valid for one year
- Customer pays return shipping
Refund to Original Payment Method
- Subject to 15% restocking fee
- Shipping is non-refundable
- Customer pays return shipping
Refunds are issued after inspection.
Non-Returnable Items
The following are final sale:
- All auction items
- Items marked “Final Sale”
- Items discounted 30% or more
- Consignment items
- Equipment, machinery, vehicles, trailers, firearms, and titled property
- Bulk lots or liquidation items
- Customized or special-order items
III. GENERAL POLICIES (Applies to All Sales)
Shipping
Shipping costs are non-refundable.
If we assist with shipping coordination, risk transfers to the buyer once the item leaves our facility.
Technical Failures
Kansas Auction Service is not responsible for internet outages, platform malfunctions, software errors, or device failures.
We reserve the right to reopen, extend, cancel, or modify bidding due to technical issues or clerical errors.
Chargebacks & Payment Disputes
Initiating a chargeback on a valid purchase constitutes breach of contract.
Buyers agree to reimburse all chargeback fees and administrative costs. We reserve the right to suspend bidding privileges, pursue collections, and seek legal remedies.
Premises Liability
Buyers and their agents enter auction premises at their own risk. Kansas Auction Service is not liable for personal injury, accidents, or property damage occurring on auction premises.
Governing Law
All disputes shall be governed by the laws of the State of Kansas.
Policy Enforcement
Kansas Auction Service reserves the right to:
- Refuse service
- Cancel or withdraw lots due to clerical error or seller request
- Modify policies at any time
- Make case-by-case determinations when appropriate
